Please read the following terms and conditions (the “Official Rules”) carefully. By entering this Contest, you (“Entrant” or “you”) are agreeing to be bound by these Official Rules.
1. CONTEST DESCRIPTION
1.1. The 2019 PUBG Awards Contest (the “Contest”) is a skill contest in which Entrants are invited to post a 30 second video in response to a four (4) challenges that are communicated at on Twitter.com . The Contest is being conducted through the online property ‘Twitter’ and entries must be posted on Twitter AND must include “#PUBGAwardsEU” to be eligible. Entries will be judged and scored based on specified judging criteria to determine winner(s).
2. CONTEST SPONSOR AND ADMINISTRATOR
2.1. The Contest is being organised by PUBG CORPORATION, a company, with its registered office at 6, 7, 8F Majestar City Tower 1, 12, Seocho-Daero 38-Gil, Seocho-gu, Seoul, Republic of Korea (the “Sponsor”).
2.2. This Contest is being operated by Marden-Kane, Inc., a company, with its registered office at 575 Underhill Blvd, Suite 222, Syosset, NY 11791, United States of America (the “Administrator”).
3. CONTEST PERIOD
3.1. The PUBG “2019 PUBG Awards” Contest starts on December 02, 2019 at 01:00:00 PM Greenwich Mean Time (“GMT”) and ends on January 28, 2019 at 07:59:59 AM GMT (the “Contest Period”). During the Contest Period there are a series of Events (“Events”) which start and end on the dates and times noted below (each period a “Submission Period”):
4.1. Subject to the remainder of this paragraph, the Contest is open to legal residents of the United Kingdom who are 18 years old and above at the time of entry and have a copy of the PUBG video game. Employees of the Sponsor, and its parent company, related subsidiaries and affiliated companies, and agents, suppliers, advertising and promotion agencies, or any company that is professionally connected with the Contest or its administration including Administrator and each of their respective agents, representatives, officers, directors, shareholders, and employees (collectively “Released Entities”), and the immediate families (spouse, and parents, children and siblings, and their respective spouses regardless of where they live) and individuals living in the same households, whether related or not, of the above, are not eligible to enter the Contest or win a prize. By participating in the Contest, each Entrant agrees to be bound by these Official Rules. Void where prohibited or restricted by law. The Contest is subject to all applicable laws and regulations.
5. HOW TO ENTER
5.1. You must be a registered user of https://www.twitter.com/ (“Twitter”) and have a valid Twitter account to enter the Contest. Your account and entry must be set to “public”. You can return your account to “private” after the winner announcement. Twitter is not a participant or sponsor of or otherwise associated with this contest and does not endorse or administer this contest in any manner. To the extent permitted by applicable law, Entrants release Twitter from all liability arising from participation in the Contest. Twitter’s Terms of Service and Rules and Policies apply. No purchase of any product or service is required to enter this Contest.
5.2. During the Contest Period, the Sponsor will post four (4) challenges at the beginning of the Contest (each a “Challenge”). The Challenges will direct Entrants to perform in-game activities, capture a video of meeting this Challenge (each, a “Video”), and post the Video, along with the hashtag #PUBGAwardsEU to Twitter.
5.3. Each video post (including the Video content itself and any information or text accompanying such post) shall be referred to herein as an “entry”. Entries must comply with the Guidelines and Content Restrictions set out below.
5.4. Entrants may enter a maximum of one (1) entry per Challenge and a maximum total of four (4) entries during the Contest Period. If multiple entries are submitted in respect of a single Challenge, only the first entry received will be valid, all other entries will be disqualified. The Sponsor reserves the right to refuse an entry of any individual to the Contest who submits or attempts to submit more than one (1) entry per Challenge.
5.5. To Enter:
5.5.1. Capture a Video of your in-game activity in response to the Challenges. The Challenges will posted online on Twitter on the following date and at the following time:
• 4 Challenges to be posted on Twitter on November 29, 2019 at 01:00:00pm GMT
All Videos must be no more than 30 seconds in duration. The Video must be your own original creation and you must have permission from all persons featured in the Video for their participation in the entry.
5.5.2. Go to https://www.twitter.com/ and log into your Twitter account.
5.5.3. Your Twitter account must be set to public.
5.5.4. You must follow @PUBG to enter via Twitter.
5.5.5. Post your Video before the Submission Period closes (please see table above) and include both of the following hashtag: #PUBGAwardsEU.
5.6. Entries submitted that do not include (1) the hashtags #PUBGAwardsEU; and (2) a Video (maximum of 30 seconds in length) in response to the corresponding Challenge will NOT be eligible for entry into the Contest. Any Video posted for a specific Challenge that is received AFTER the corresponding Submission Period has closed will not be a valid entry into the Contest. Note: If any video is longer than 30 seconds, only the first 30 seconds of the video will be judged.
5.7. Usage of Twitter may require a mobile device with connection to the internet and therefore you may be charged for standard data rates or fees from your mobile device according to the terms and conditions in your agreement with your wireless carrier. You agree to incur any and all charges demanded by your wireless carrier and no refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in this Contest. You should also check your device’s features for capabilities and check the device manual for specific use instructions.
5.8. The person submitting the entry must be both the Entrant and the authorized account holder of such Twitter account, otherwise the entry may be deemed void (at the Sponsor’s sole discretion). In the event of a dispute over the identity of a potential winner, the entry will be deemed made by the authorized holder of the Twitter account used for such entry, and the potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such Twitter account. The “authorized account holder” is the natural person assigned to the applicable Twitter account by Twitter. It is the sole responsibility of the Entrant to notify the Sponsor in writing if the Entrant changes his or her Twitter account during the Contest Period. All entries are deemed to have been received at the time of entry into the Sponsor’s database and not at the time when the entry is uploaded or sent to Twitter by the Entrant. Multiple Twitter accounts may not be used to enter this Contest and anyone found to have used multiple Twitter accounts to enter will be disqualified.
5.9. Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices. The Sponsor reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.
5.10. Neither the Sponsor nor the Administrator accepts any responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.
6. Guidelines and Content Restrictions
6.1. The following guidelines and content restrictions apply:
- Formats: any format that can be uploaded to a publicly available link. No unlisted, private or direct Video entries will be eligible.
- Length: no longer than 30 seconds.
- Ownership: any Video submitted by an Entrant must be the original work of the Entrant. Curated clips of or from other players will be disqualified.
- Capture: Content captured must be from the live public build of the game. Your entry will not be eligible if you use user-controlled gameplay capture environments or bots to capture your Video.
- Content: Videos and entries must be appropriate for public viewing and must not contain: (a) anything which may be considered defamatory, inappropriate, offensive, derogatory, abusive, unlawful, obscene, pornographic, sexually inappropriate, harassing, threatening, objectionable with respect to race, religion, origin or gender, unsuitable for children, or otherwise unsuitable for publication; (b) anything which infringes or may infringe the intellectual property rights (such as unlicensed music, a company’s logos or branding etc.), privacy or confidentiality rights, personality rights, image rights or any other rights whatsoever of any third party; (c) anything which denigrates or may denigrate (in the Sponsor’s sole discretion) the Sponsor’s brand, the Contest, or any other third party brand, product or service; (d) swear words, inappropriate language, nudity, violence, imagery or themes of an adult or sexual nature; or (e) any other materials or content which the Sponsor considers (in its sole
discretion) to be contrary to the nature and spirit of the Sponsor brand or the Contest. Notwithstanding the foregoing, the Sponsor shall be under no obligation to display or otherwise exploit the Video(s) or entries.
- Your entry must include the hashtag: #PUBGAwardsEU . Your entry will not be eligible if the hashtag is omitted. Entries may only be submitted by a single Entrant.
6.2. By submitting an entry, you acknowledge that your entry (including your username and profile picture) may be posted on various online properties including Twitter, YouTube channels, Facebook, Instagram, sponsor’s proprietary website, and other platforms where it may be viewed, shared (by users of Twitter and various other internet-based sites) and commented on by the Sponsor and the general public.
6.3. The use or publication of an Entrant’s entry in connection with the Contest, in any manner by the Sponsor, does not signify that the Entrant is a Contest or prize winner.
6.4. By submitting an entry for the purposes of entering this Contest, Entrant grants to the Sponsor, its parent company, subsidiaries, and affiliates and its agents and designees a non-exclusive, sub-licensable, perpetual, worldwide, royalty-free licence to use such entry (including the right and permission to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, and use the content of and elements embodied in the entry, in any media now known or hereafter devised (including without limitation, the Internet)), for the operation of the Contest, for marketing, advertising and promotional purposes, and for internal business purposes without any compensation, except where prohibited by law. To the extent permitted by applicable law, Entrants waive all so-called moral rights in and to the entry. Each Entrant hereby represents and warrants that he/she is the original author/creator of his/her entry and the entry will not infringe any third party’s copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy. Sponsor’s use of information submitted to Sponsor in connection with this Contest will be subject to the terms and conditions of these Official Rules.
6.5. Each Entrant acknowledges that other Contest participants may have used ideas and/or concepts in their entry that may be similar in idea or concept to what is included in Entrant’s entry. Each Entrant understands and agrees that he/she shall not have any claim against any other Entrant or Sponsor arising out any such similarity or be entitled to any compensation because of any such similarity.
7.1. Once the entry Submission Period has closed, all entries received during the Submission Period will be judged by an independent panel of judges selected by the Sponsor. The Sponsor may reject, refuse, remove, delete and/or disqualify any entry that does not comply with these Official Rules. All decisions of the Sponsor in this regard are final and binding. Each eligible entry will be reviewed by a panel of independent judges selected by the Sponsor. The panel of judges will review the entries based on the following judging criteria (“Judging Criteria”):
- Appropriateness of video to the challenges (40% of total score)
- Creativity/Originality (40% of total score)
- Humor (20% of total score)
7.2. Each Entrant has the potential to earn a total score of 100. In the event of a tie, the tied entries will be re-judged by a different panel of independent judges selected by the sponsor. The judging panel’s decision shall be final and no correspondence shall be entered into. The names of the judges for the Contest are available on request.
7.3. The fifty-six (56) valid entries with the consecutive highest scores will be each be deemed “Challenge Winners” according to the following prize tiers:
- 1st place: 1 Challenge Winner
- 2nd place: 5 Challenge Winners
- 3rd place: 50 Challenge Winners
7.4. Each Entrant may be deemed a Challenge Winner a maximum of one (1) time during the Contest Period. Challenge Winners are automatically eligible to win a Fan Favorite Grand Prize.
7.5. Sponsor will contact each Challenge Winner within [fourteen (14) days] following the end of the applicable Submission Period via private message to the Twitter account they used to enter the Contest.
7.6. The Challenge Winners will be required to respond to the direction in the message within 48 hours with full contact information and other requested information. Before receiving a prize, Challenge Winners may be required to complete and sign and return any documents and releases reasonably requested by the Sponsor, which must be returned within two (2) days of notification date or the Challenge Winner may be disqualified. The Challenge Winner, in Sponsor’s sole discretion, may be required to prove eligibility, including proof of age, residence, identity (which may include a copy of proof of residence, passport or similar government issued identification) and ownership of the respective Twitter account that submitted the entry, and may be asked to demonstrate control of the Twitter account. If there is any dispute as to the identity of any of the Challenge Winners, the decision of the Sponsor shall be final. In the event that a Challenge Winner cannot be contacted, fails to respond to a direct message notification with the requested information within the required time-frame or Sponsor receives a return of notification as undeliverable, such Challenge Winner being disqualified. Sponsor shall have no further obligation to a Challenge Winner who is disqualified and the next highest scoring entry will be deemed a Challenge Winner, at Sponsor’s discretion, time permitting. In order to receive the direct message notification, the Challenge Winners’ device and respective settings must be set to receive direct message notifications on Twitter.
7.7. The delivery details of the prizes shall be determined by the Sponsor in its complete discretion. Details of delivery of the prizes (including but not limited to the time, date and location of delivery) shall be provided to the Challenge Winners upon notification.
7.8. Public voting:
7.8.1. The entries of the top four (4) 1st place confirmed Challenge Winners will be presented to the public for a public vote for the Fan Favorite Grand Prize winner (the “Grand Prize Winner”) by PUBG on a Twitter Poll from January 20, 2020 to January 23, 2020 (“Public Voting”). Maximum one (1) vote per Twitter account and voters must not make multiple Twitter accounts for the purposes of voting. Votes will not be valid where they are made using methods generated by a script, macro or the use of automated devices. The Sponsor reserves the right to verify the validity of votes and to exclude votes it believes have been made using any automated voting techniques or multiple account creations. At the conclusion of Public Voting, the one (1) Challenge Winner with the entry that has the highest number of valid votes will be deemed the Grand Prize Winner, will be notified and, subject to final verification and acceptance as described below, will be deemed the Grand Prize Winner. Sponsor’s independent judging panel to determine the Grand Prize Winner if a tie exists.
7.8.2. Grand Prize Winner Notification: The Grand Prize Winner and will be notified via Twitter direct message on or around January 24, 2020. The Grand Prize Winner may be required to complete and return an IRS Form W-9 (furnishing his/her social security number) that will be used only for the purpose of reporting the Winner’s prize earnings to the Internal Revenue Service, as required by law.
8.1. There will be  prizes awarded in total:
8.2. In addition all winners will receive one (1) in-game T-Shirt featuring the PUBG Awards logo – no estimated retail value. No more than the number of prizes listed above will be awarded.
8.3. No substitutions, or transfer of prizes are permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value if the specified prize becomes unavailable for any reason outside of the Sponsor’s control, except as otherwise provided herein. Prize winners are responsible for the payment of taxes on a prize and for any other costs and expenses associated with the acceptance and use of the prize. The prizes are non-negotiable, may not be exchanged for any cash or other alternative, are not transferable, divisible, permitted to be sold or resold, or offered for sale by the winners and are not for use in conjunction with any other promotion or offer. The prizes cannot be replaced or refunded in the event of loss, theft or missed opportunity.
8.4. Unsuccessful Entrants will not be notified.
9.1. By entering into this Contest and/or receiving a prize, Entrants agree to be bound by these Official Rules and the decisions of the Administrator and the Sponsor, which shall be final and binding in all respects and waive any right to claim ambiguity in the Contest or these Official Rules. These Official Rules are accessible at www.PUBG.com and throughout the Contest Period. The Sponsor reserves the right, at its sole discretion, to disqualify any individual: (a) suspected of tampering with the entry process or the operation of the Contest; (b) to be acting in any manner deemed by the Sponsor to be in violation of the Official Rules; (c) to be acting in any manner deemed by the Sponsor to constitute unsportsmanlike or disruptive behavior, or with intent to annoy, abuse, threaten or harass any other person. Caution: any attempt by a user or Entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and costs (including without limitation, attorneys’ fees) from any such person to the fullest extent permitted by law.
10. LIMITATIONS OF LIABILITY
10.1. Without prejudice to an Entrant’s statutory rights as a consumer (including Entrant’s rights to receive a reasonable standard of service, more details about which can be obtained from your local Trading Standards Office or Citizen’s Advice Bureau, available at https://www.citizensadvice.org.uk/) and to the extent permitted by applicable law, the Sponsor, its agents or distributors and the Released Entities will not be responsible or liable to compensate any of the Challenge Winners or Grand Prize Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the Contest.
10.2. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software failure or any email or entry to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website or any delay or failure of any postal or equivalent delivery service or any combination thereof, including injury or damage to the Entrant’s or any other person’s computer or mobile telephone related to or resulting from participation in the Contest. Nothing in these Official Rules shall exclude the Sponsor’s liability for fraudulent misrepresentation, death or personal injury as a result of negligence or any other liability that cannot be excluded or restricted by applicable law.
12. GOVERNING LAW AND JURISDICTION
12.1. The Contest and these Official Rules are governed by the laws of the England and Wales.
12.2. Nothing in these Official Rules will prevent any rights you may have:
12.2.1. to bring a claim in the courts of England or Wales or Scotland if you are resident there; and
12.2.2. under European law to bring a claim via the European Commission’s Online Dispute Resolution mechanism (available at https://ec.europa.eu/odr).
13. WINNER LIST
13.1. The Sponsor is required to either publish or make available information that indicates that a prize has been awarded (the “Winner List”). Consequently, the Sponsor will either publish the surname and county of Challenge Winners and the Grand Prize Winner and, if applicable, their winning entries on Twitter or send the surname and county of Challenge Winners and the Grand Prize Winner and, if applicable copies of their winning entries, to anyone who contacts the Sponsor at the address given above within three (3) months following the end of the final Submission Period of the Contest.
13.2. If any of the Challenge Winners and the Grand Prize Winner objects to any or all of their surname, county and winning entry being published or made available, they should contact the Sponsor at the address given above. In such circumstances, the Sponsor must still provide the information and winning entry to competent authorities (including, for the United Kingdom, the Advertising Standards Authority) on request.
13.3. To receive a copy of the Winner List, available after January 28, 2020, send an email with subject line: “PUBGAwards2019” to email@example.com. All such requests must be received within three (3) months following the end of the final Submission Period of the Contest.
14.1. Events may occur that render the Contest itself or the awarding of any prize impossible due to reasons beyond the Sponsor’s control and accordingly, the Sponsor may, at its absolute discretion, vary or amend the Contest.
14.2. The Sponsor may instruct a third party agency (including the Administrator) to operate the Contest, including the monitoring and reviewing of submitted entries and, to the extent that such entries do not meet the eligibility criteria or otherwise infringe these Official Rules, such agency may disqualify such entries at its discretion.
14.3. The Sponsor reserves the right to refuse entry of any individual to the Contest or future events organised by the Sponsor where: (i) an Entrant has been disqualified from any promotion held by the Sponsor within twelve (12) months preceding the start date of the Contest; or (ii) such individual is ineligible to participate in the Contest (or if participation in the Contest should have been refused for any reason whatsoever).
14.4. In the event of any dispute over the time or date of any entry submitted, the decision of the Sponsor shall be final.
14.5. The entry and all materials, information and content submitted as part of the entry (except for the Video), with all associated copyright and other proprietary rights, become the property of the Sponsor upon submission, and the Entrant hereby assigns to the Sponsor (by way of present assignment of present and future copyright) all intellectual property rights in and to such materials, information and content for use and exploitation for all purposes by the Sponsor and its nominees in all media now known or hereafter developed.
14.6. It is advised that all Entrants retain a copy of these Official Rules for future reference
14.7. Twitter is a registered trademark of Twitter, Inc. This Contest is in no way sponsored, endorsed, or administered by, or in association with Twitter. Entrants understand that you are providing your information to Sponsor, and not to Twitter. Any questions, comments or complaints regarding the Contest are to be directed to Sponsor, at the address noted above, not Twitter.
